A long-serving Physical Education teacher from a prominent independent school in Portsmouth has been handed an indefinite classroom ban following a professional conduct panel. The Teaching Regulation Agency (TRA) ruled that Stuart Smith’s behavior toward a vulnerable female pupil breached fundamental professional boundaries, bringing the teaching profession into disrepute.

The incidents took place during his tenure at Mayville High School, a co-educational independent school located in Southsea, Portsmouth. Smith, who was a senior figure within the school’s sports department, was found to have crossed serious professional boundaries through a series of physical actions and suggestive remarks directed at a student.

The Allegations and the TRA Panel’s Findings

The professional conduct panel met in May 2026 to review extensive evidence regarding Smith’s interactions with a student, referred to in official documents as Pupil A. The investigation centered on events that occurred during school sports sessions and private interactions on the school premises.

1. Inappropriate Physical Contact

The panel found proved an allegation that Smith had made physical contact with Pupil A’s lower back area in a manner that went entirely beyond standard athletic instruction. Witnesses and testimonies confirmed that Smith rubbed the student’s back during a sports session, an action the panel concluded was completely unnecessary for the sporting activity being taught.

2. Suggestive and Unprofessional Language

In addition to the physical contact, Smith targeted the student with highly inappropriate verbal comments. The panel heard that Smith looked at Pupil A and remarked that she was “Premier League,” while comparing other students in the group to lower-tier football divisions, specifically calling them “Championship” or “League One.”

While Smith’s defense argued that the terminology was a purely sporting metaphor intended to praise the student’s athletic ability, the TRA panel rejected this interpretation. Given the context of his physical behavior and the discomfort expressed by the student, the panel concluded the remark carried an inappropriate, dual-meaning undertone.


Panel Concludes Misconduct Was Improperly Motivated

A crucial component of the TRA hearing was determining whether Smith’s actions were accidental or structurally inappropriate. After reviewing the sequence of events, the panel declared that his conduct was improperly motivated and driven by personal interest rather than professional duty.

In the official ruling report, the decision-makers stated:

“The panel was satisfied that Mr. Smith’s actions, both physical and verbal, were directed toward Pupil A with improper motives. The behavior displayed represents a significant failure to maintain the professional boundaries required of an educator, particularly a physical education teacher who is regularly placed in positions of trust regarding instructional guidance.”

The panel further noted that Smith showed a distinct lack of insight throughout the initial investigation and subsequent hearings, consistently attempting to minimize the impact of his actions on the young student.


Immediate Dismissal and School Response

Mayville High School acted swiftly once the allegations were formally brought to the attention of the senior leadership team. Following an internal disciplinary procedure that ran parallel to safeguarding notifications, Smith’s employment at the Southsea school was terminated.

In a statement addressing the conclusion of the regulatory hearing, the administration of Mayville High School emphasized their commitment to student safety:

  • Zero Tolerance: The school reiterated that the safety, well-being, and emotional security of its pupils remain its absolute highest priority.
  • Decisive Action: Upon receiving the initial complaint from the student’s family, the individual was immediately suspended from all teaching duties and prohibited from entering the school grounds pending the outcome of the full investigation.
  • Safeguarding Compliance: The school worked in total transparency with the Local Authority Safeguarding Officer (LADO) and the TRA to ensure all regulatory obligations were thoroughly met.

The Indefinite Prohibition Order

As a consequence of the panel’s findings, the safe-guarding body has issued an Indefinite Prohibition Order against Stuart Smith. This means he is banned from carrying out any teaching work in any school, sixth-form college, relevant youth accommodation, or children’s home in England.

The panel chose not to implement a standard review period, meaning the ban is permanent. While Smith retains the legal right to appeal the decision to the High Court within 28 days, the current order ensures he cannot step foot inside a UK classroom for the foreseeable future.
